Definitions
"HostSite" is HostSite Pty Ltd. (ACN 003 482 906). The "Client" means the individual or corporate entity subscribing to services provided by HostSite.
Provision of Services
The use of the Service is at the Clients own risk. The Service is not guaranteed to be uninterrupted or fault-free, and it is understood that the Service may be occasionally affected by factors beyond the HostSite's Control. By using the Service, the Client agrees to be bound by these Terms and Conditions, Acceptable Use Policy and any announcements that may be made either via email or as displayed on HostSite's Home Pages. Domain Names
HostSite is not liable for any delays that may occur when registering a domain name. Approval of a Domain Name is subject to the Delegation Authority accepting the application. It is advisable that all applicants read the policies in relation to registering a Domain Name before making the application. After an initial period (usually two years), the Delegation Authority for your Domain may require the Domain Name to be renewed. Any fees incurred will be passed onto the Client.
Payments
Credit card
Accounts paid by Credit Card are to be paid either monthly, quarterly, half-yearly or yearly. HostSite will automatically rebill a customer's credit card, where credit card details have been provided on a monthly, quarterly, half yearly or yearly basis unless notified otherwise.
HostSite will provide invoices online for all Credit Card transactions including any excess hour or data charges on a monthly basis.
HostSite may automatically debit your Credit Card any outstanding charges at any time, including after termination or suspension of Internet access.
Account
Accounts that are paid by Cheque/ Cash/ Australian Money Order/ Direct Deposit/ BPAY are to be quarterly, half yearly, or yearly. You will be rebilled automatically after each payment period.
All monies paid to HostSite are non-refundable.
It is not HostSite's responsibility to ensure you are connecting at a local call to the Internet. Please check with your carrier.
Suspension
HostSite reserves the right to suspend accounts due to non-payment, dishonoured cheques or abuse.
Suspension of an account does not terminate the agreement already entered by the customer. Your current charges will continue until such time as you pay any overdue amounts.
Termination
HostSite reserves the right to cancel Services to a Client without notice at any time if the Client has contravened any of the Terms and Conditions or Acceptable Use Policy.
The Client may terminate this agreement at any time with fourteen days notice to HostSite and any outstanding fees shall be payable immediately. Notice must be given by either Electronic Mail (email), Fax, or Post. Telephone terminations are inadequate. This is not applicable to Broadband services which require 30 days written notice. Should the customer have already been charged for their next payment period HostSite will not issue a refund.
Clients who sign up for the yearly or quarterly plan may not be entitled for any refunds should the account be closed before the end of the current cycle.
Clients paying by "Account" must notify HostSite of their intent to cancel Services prior to the beginning of the next payment period or outstanding fees will have to be paid before the service is cancelled.
Changes
HostSite reserves the right to amend these Terms and Conditions at any time, and shall serve notice of any such changes fourteen days in advance
Exclusion of Liability
HostSite shall not have any liability in contract, or otherwise to any person in respect to any loss or damage arising from the Provision of Services or of any inaccuracy, errors or omissions from any part of the HostSite's computers, it subsidiaries and suppliers. HostSite makes no guarantee as to the Clients ability to access any part of the Service at any time.
